Puppy Purchase Agreement

This Puppy Purchase Agreement (hereinafter the “Agreement”) is between Manor Lake Australian Labradoodles LLC, & MLA Labradoodles LLC/, hereinafter called “Seller,” and Buyer whose information is listed below (hereinafter called “Buyer”).

The Seller and Buyer agree as follows:

1. Purchase Price. The purchase price of the above-described Manor Lake Australian Labradoodle puppy (“Puppy”) is $______ (“Purchase Price”), which is payable in full upon signing of this Agreement by both parties. Buyer’s Initial_______

2. Limited 2 Year Health Guarantee. The Puppy comes with a two (2) year genetic health guarantee for Hip Dysplasia and Progressive Retinal Atrophy disease. Seller will replace the Puppy with a puppy from another litter when available at no charge except shipping, or 50% of the Purchase Price will be refunded if any of the above occurs. Seller must receive all diagnostic veterinarian data from a fully licensed Doctor of Veterinary Medicine (“DVM”), including x-rays and receipts. Findings and data will be reviewed by a veterinarian of Seller’s choosing & sent to The Orthopedic Foundation for Animals (“OFA”) for evaluation.  In the case of Hip Dysplasia, the guarantee is voided if it is caused by: (i) allowing the Puppy to become overweight or (ii) allowing the Puppy’s diet to consist of low grade commercial dry foods.   Buyer’s Initials_________

3. Certification. Seller certifies that the Puppy is in good health at the time of sale. This certification, along with the genetic health guarantee located in Section 2, hereinafter referred to as the “Health Guarantee”. Buyer will have the Puppy examined by a veterinarian of its choice for a wellness exam within seventy-two (72) hours of receiving said Puppy. Seller must be notified within seventy-two (72) hours of any concerns. A signed copy of this contract must be returned prior to picking up the Puppy and a copy of the veterinarian’s report sent back to Seller within seven (7) days of receipt of the Puppy. Failure to return this guarantee with veterinarian documentation will result in a void of the guarantee and release Manor Lake from all contractual obligations. Buyer’s Initials_________

4. Vaccinations. Seller certifies that the Puppy has received all current age and breed appropriate vaccinations, deworming and microchipping. Included with the Puppy are copies of vaccination records, wellness visit records, spay/neuter certificate if applicable, microchip registration information, collar, leash and sample bag of food. Rabies vaccine can be administered at 12 weeks of age if traveling, otherwise it is best to wait until after 17 weeks of age. Rabies has the most adverse side effects of any vaccine. Buyer agrees that at the time of rabies vaccine, NO other vaccines will be given to the Puppy in conjunction to rabies vaccine. Rabies will be the only vaccine given at the time. 5. Returns. If the Puppy is shown to be in poor health (documented by a licensed veterinarian) within three (3) days of receiving it, Buyer may return the Puppy to get a refund of up to $3,000.00 or a new dog. No surgery or similarly invasive procedure is to be performed on the Puppy without providing Seller two (2) days’ time to receive a second opinion. If Buyer incurs any expense during the initial wellness visit, Seller will not be responsible for any vet bills unless prior consent is given in writing. This Health Guarantee does not include minor illnesses and health issues such as colds, allergies, dermatitis, mange, internal or external parasites or umbilical hernias. Additionally, no replacement puppy will be provided if the poor health is a result of heat stroke, abuse, neglect, or improper socialization. Manor Lake will take dog back anytime, anywhere. Buyer is subject to half of the $3,000 if puppy is returned under four (4) months of age, provided the Buyer can provide proof of regular training. 6. Pet Insurance. As part of the adoption of the Puppy, Manor Lake requires Buyer’s participation in a thirty (30) day free trial pet insurance plan through Trupanion Pet. Twenty-four (24) hours prior to picking up the Puppy, Buyer must activate this trial and provide proof of such activation. The activation code necessary for activating the Seller’s promotion through Trupanion pet is: BR1ML121113 for all states except New York, BR2ML231113 for New York residents. 7. Travel. Pickup and travel arrangements are made on a case by case basis after puppy/dog is paid for.  Buyer’s Initial_______

8. Boarding. If said puppy or dog needs to stay later than their scheduled pick up date due to personal client timing conflicts, there will be a one-week minimum boarding fee of $250.00 USD charge per week. Buyer’s Initial_______

9. Insufficient Care. If for any reason Buyer is no longer able to care for or keep the Puppy, Buyer agrees to give the Puppy back to Manor Lake Australian Labradoodles. Buyer agrees that it will not surrender the Puppy to a shelter and that it will not sell, give, or release the Puppy to an individual or family, pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility. Additionally, Buyer agrees that it will not euthanize the Puppy under any circumstances without prior written consent of Seller and instead will return to Seller. If the Puppy is returned within the first thirty (30) days, only half of the Purchase Price will be refunded after the Puppy has been placed in its new home. The other half will cover the cost of readvertisement, keeping the Puppy current on vaccinations and deworming until the Puppy’s new home has been found. If the Puppy is returned after the thirty (30) days no money will be refunded to the Buyer. The Buyer pays for all travel expenses back to Seller. Buyer’s Initial________

10. Biting/Training. Puppy mouthing and biting is a normal stage of puppy development and will not be considered justifiable cause for return of the Puppy. Please see Seller’s website for information on puppy training and how to handle this normal stage. Additionally, temperament behavioral issues will not be considered justifiable cause for return of the Puppy; unless proof of regular obedience training by a certified professional trainer is provided and the Puppy is under four (4) months of age at the time of return. 11. Teeth. Imperfect puppy bites in pet quality puppies can and do happen. This is typically resolved once puppy baby teeth fall out and adult teeth come in. Base Narrow Canines (“BNC”)/imperfect bites are not covered under the Health Certification and are not considered justifiable cause for returning the Puppy. Buyer’s Initial____

12. Condition at Delivery. Seller makes every possible attempt to provide Buyer with a healthy puppy to be a forever companion. Seller tests all breeding dogs in accordance with the highest breed and industry standards. Despite extensive health testing and careful breeding selections, there are medical issues which cannot be tested for and cannot be foreseen. Congenital conditions (conditions that are not genetic or hereditary) are not covered under the Health Guarantee as they are out of Seller’s control. Seller takes reasonable measures to provide Buyer with a happy, healthy, thriving Puppy. By initialing this, Buyer acknowledges that Buyer has read and understood that Seller’s Health Guarantee covers inherited genetic disorders only. Buyer’s Initial___________

13. Non-Transferability of Health Guarantee. Seller’s Health Guarantee applies only to the Buyer and is non-transferrable to another owner. Any transfer or assignment of this Health Guarantee is void. Buyer’s Initial__________

14. Visits to Veterinarians. On visits to Buyer’s veterinarian, the Buyer agrees to hold the puppy in their arms or contained in a crate until you are provided with a sterilized examination room to reduce the risk of infection, in particular, Parvovirus. The puppy will not be taken to places other dogs frequent, such as pet stores, dog parks, kennels, grooming salons, etc., as the puppy has not been fully vaccinated. Buyer’s Initial_____

15. Companion Purpose; Mandatory Spaying or Neutering. This Puppy is being sold as a companion pet only and is fit for this purpose only, NOT for breeding purposes. If this Puppy is being sold as a breeding dog, a separate contract and price apply. For companion pets, we REQUIRE the Buyer agrees to have the Puppy spayed or neutered before or during six (6) – eight (8) months of age. We require that the Buyer provides Seller with proof of spay/neuter, proof must be provided on veterinary hospital letterhead, showing the Puppy’s name, date of birth, and microchip number, and such proof of spay/neuter will be provided to Seller no later than the Puppy’s nine (9) month birthdate.  If proof is not received by the Seller by the required date, Seller shall have the right to reclaim the Puppy without compensation to the Buyer, or Seller may charge Buyer (and Buyer will pay upon demand) the sum of $15,000 as a breeding fee. If necessary, legal action will be taken to collect damages, and fees, and the Buyer will be responsible for all attorneys’ fees, court costs and other expenses of recovery. This Agreement will be constructed in accordance with the laws of Texas. If any legal action is to be taken by either Buyer or Seller, the venue shall be in Texas. Buyer’s Initials______

16. Size/Color; Disclaimer. Adult size, conformation, coat quality, color and pattern of the Puppy are not guaranteed by Seller. The Seller assumes no responsibility and shall have no liability to Buyer for the Puppy’s health after it leaves the premises except for the limited Health Guarantee provided for in this Agreement. The Seller is not responsible for the Puppy’s medical expenses, mortality, or behavior for any reason whatsoever including (without limitation) family disagreement, divorce, accidental injury or any other reason. It is understood that no warranty or representation has been made regarding this Puppy except as set forth in writing in this Agreement. It is further agreed that the Puppy is of pet quality for the expressed purpose of a companion pet.  In the event, the Seller stops breeding, no replacement puppies shall be given, and any obligations of providing a replacement puppy is limited by the supply of available puppies that Seller has on hand at any given time. 17. Annual Vaccinations and Protective Medications.  Buyer guarantees that upon receiving the Puppy, Buyer will keep the Puppy in good health with yearly vaccinations, heartworm protection, and any other necessary procedures to ensure the good health of the Puppy. Buyer’s Initial_____

18. Governing Law and Venue.  This Agreement shall be governed by, and construed, enforced and interpreted in accordance with, the substantive laws (without regard to its conflicts of laws provisions) of the State of Texas. The parties hereto irrevocably submit to the jurisdiction and venue of any state or federal court sitting in Harris County, Texas over any suit, action or proceeding arising out of or relating to this Agreement.  Venue shall be mandatory, and not permissive.
